S.Arch PSC ("S.Arch," "we," "us," or "our") is a professional services corporation organized under the laws of the Commonwealth of Puerto Rico, providing architectural, planning, and related design services. This Privacy Policy describes how we collect, use, disclose, and safeguard information when you visit our website (the "Site") or engage our professional services.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

  • For Legal Compliance: When required by law, court order, subpoena, or governmental request, including disclosures to Puerto Rico OGPe, ARPe, municipal Permit Offices, FEMA, HUD, or other regulatory bodies.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website operated by S.Arch PSC ("S.Arch," "we," "us," or "our"), a professional services corporation duly organized under the laws of the Commonwealth of Puerto Rico. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.

2. Nature of Services

S.Arch is a licensed architectural firm offering professional architectural, planning, permitting, design, and consulting services in Puerto Rico and other jurisdictions where duly authorized. The content on the Site is provided for general informational and marketing purposes only and does not constitute professional advice, an offer to perform services, or the establishment of a client–architect relationship. A formal written agreement is required before any professional services are rendered.

3. No Professional Advice

Information presented on the Site, including descriptions of projects, methodologies, regulatory frameworks, and design concepts, is provided "as is" and shall not be relied upon as a substitute for professional consultation. Architectural, engineering, zoning, permitting, and code-related matters require site-specific analysis by qualified professionals. S.Arch disclaims all liability for actions taken or not taken based solely on Site content.

4. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, photographs, renderings, drawings, designs, plans, videos, and software (collectively, "Content"), is the exclusive property of S.Arch PSC or its licensors and is protected by United States copyright, trademark, trade dress, and other intellectual property laws, as well as the laws of the Commonwealth of Puerto Rico.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content without our prior written consent, except for personal, non-commercial viewing of the Site.

The "S.Arch" name, logo, and associated marks are trademarks of S.Arch PSC. Unauthorized use is strictly prohibited.

5. Project Imagery and Confidentiality

Photographs, renderings, and project descriptions displayed on the Site may include works completed by or attributable to S.Arch. Such display does not waive any confidentiality, copyright, or contractual rights held by S.Arch or its clients. S.ARCH DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, NOR THAT DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, S.ARCH PSC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONSULTANTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless S.Arch PSC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (i) your use of and access to the Site; (ii) your violation of these Terms; (iii) your violation of any third-party right; or (iv) any content you submit through the Site.

The Site may contain links to third-party websites or resources. S.Arch does not endorse and is not responsible for the availability, accuracy, or content of such third-party resources. Your use of any third-party site is at your own risk and subject to that site's terms and policies.

We reserve the right, at our sole discretion, to modify, suspend, or discontinue any aspect of the Site at any time, with or without notice. We may also revise these Terms periodically. Continued use of the Site after such modifications constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and, where applicable, the laws of the United States of America, without regard to conflict-of-law principles. Any dispute arising under or related to these Terms shall be brought exclusively in the courts of competent jurisdiction located in San Juan, Puerto Rico, and you consent to the personal jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. The failure of S.Arch to assert any right under these Terms shall not constitute a waiver of such right.

16. Entire Agreement

These Terms, together with the Privacy Policy and any executed professional services agreement, constitute the entire agreement between you and S.Arch regarding the Site and supersede all prior understandings.
